Privacy Policy

Applies to users of the Abersell platform in the Republic of Uzbekistan.

1. General

This Policy describes how personal data of users of the cloud platform Abersell (the “Service”) is processed. The Service is hosted on servers located in the Republic of Uzbekistan. Processing is carried out in accordance with the Law of the Republic of Uzbekistan “On Personal Data” No. ZRU-547 of 02.07.2019 and other applicable Uzbek legislation.

2. Definitions and data subjects

• “User”: a legal entity or individual engaged in retail trade, and its employees using the Service. • “User’s Customer”: a buyer whose contact details the User enters into the Service for their own customer base. • “Personal data”: any information relating to an identified or identifiable individual (name, contacts, purchase history, etc.). • “Operator”: Individual Entrepreneur Portenko Bogdan Borisovich, who determines the purposes and means of processing personal data in the Service.

3. Data we process

• Identification: owner’s name, store/organization name, taxpayer ID (if voluntarily provided). • Contact: phone, e-mail, store address. • Account: login, password hash, session tokens. • Data entered by the User: products, sales, stock, price lists, store customer base, orders. • Technical: IP address, device and browser type, event logs, for security and availability.

4. Purposes of processing

• Providing Service functionality (POS, inventory, sales, analytics, multi-location, staff roles). • Performing contractual obligations to the User, issuing invoices, accepting payments via Click and Payme. • Security, fraud prevention, incident investigation. • Technical support and communication via e-mail and Telegram. • Improving Service quality based on anonymised usage analytics. • Compliance with lawful requests from authorities of the Republic of Uzbekistan.

5. Legal basis

Processing is based on: (a) consent of the data subject expressed by registering in the Service; (b) performance of the contract with the User (public offer); (c) the Operator’s legitimate interests in supporting and developing the Service while respecting subjects’ rights; (d) requirements of the legislation of the Republic of Uzbekistan.

6. Transfer and storage

• Personal data is stored exclusively on servers located in the Republic of Uzbekistan. No cross-border transfers occur. • Data is protected by TLS encryption in transit, regular backups and restricted access. Only the Operator has access to the production database. • Card data does not pass through the Service, banking information is processed by Click and Payme on their side; the Service receives only the transaction status. • Upon account closure, data is retained for 30 calendar days and then permanently deleted. Until deletion, the User may request an export.

7. Rights of data subjects

Within the limits of Uzbek law you have the right to: • receive information about the processing of your personal data; • request access, correction, update or deletion of your data, where this does not conflict with law and the Operator’s obligations; • withdraw consent where processing is based solely on consent; • file requests and complaints with the authorised bodies of the Republic of Uzbekistan.

9. Changes

The Operator may update this Policy when Service functionality or legal requirements change. Material changes are communicated to Users by e-mail and/or in-app at least 7 calendar days in advance. The current version is always published at abersell.uz/privacy.
